Supreme Court Makes Major Abortion Decision

The Supreme Court reportedly said on Thursday that it would dismiss a case involving emergency abortions in Idaho, temporarily allowing women in the state to have an abortion when their health is at risk.

The brief, unsigned opinion stated that the case had been “improvably granted.”

The verdict reinstates a lower-court finding that blocked Idaho’s near-total abortion ban and allowed for emergency abortions at hospitals if necessary to protect the mother’s health while the issue is heard in court.

The verdict, which did not rule on the merits of the case, appeared to closely resemble a version that appeared momentarily on the court’s website the day before and was published by Bloomberg.

A court spokeswoman admitted on Wednesday that the publications unit had “inadvertently and briefly uploaded a document” and stated that a decision in the matter would be issued in due course.

The cases, Moyle v. United States and Idaho v. United States, argue whether a federal provision requiring emergency care for all patients outweighs Idaho’s abortion prohibition, which is one of the strongest in the country.

The procedure is illegal under state law, with rare exceptions unless a woman’s life is in jeopardy.
