The Michigan Supreme Court, which has a majority of Democrat-nominated judges, reportedly ruled on Monday that Robert Kennedy Jr. must appear on the battleground state’s ballot, despite his efforts to have him removed after his presidential campaign ended.
Kennedy, who endorsed former President Donald Trump after withdrawing from the 2024 race last month, has not demonstrated an entitlement to this unusual relief, and we reversed an appeals-level ruling from last week, according to a majority order.
The reversal could have far-reaching repercussions in a state where Trump defeated Hillary Clinton by nearly 10,000 votes in 2016 and President Joe Biden defeated Trump by approximately 150,000 votes in 2020.
“This plainly has nothing to do with ballot or election integrity. The aim is precisely the opposite — to have unwitting Michigan voters throw away their votes on a withdrawn candidate.” Kennedy’s attorney said in response to the ruling.
Michigan’s secretary of state, Jocelyn Benson, a Democrat, declined to remove Kennedy from the ballot, sparking the lawsuit.
The Natural Law Party had nominated Kennedy, and Benson’s office stated that minor party candidates “cannot withdraw.”
