Former President Donald Trump requested on Wednesday that his sentence in New York be delayed until after the November election.
In a letter to Judge Juan Merchan, Trump’s attorneys stated that there is no basis for continuing to rush the case, adding that the existing sentencing date of September 18 falls after early voting begins.
His attorneys argued that postponing the date is necessary to allow President Trump time to assess and pursue state and federal appellate options if Merchan rejects Trump’s move to overturn the jury’s verdict based on the Supreme Court’s July decision on presidential immunity.
Merchan stated that he would rule on the request on September 16.
Merchan denied Trump’s third request to disqualify him from the case on Tuesday, citing his daughter’s employment at the political consulting firm Authentic Campaigns, which serves Democratic clients.
Trump’s sentence was originally planned for July 11. The judge decided to postpone the date after the Supreme Court ruled that presidents are exempt from prosecution for official activities while in office.
District Court Judge Tanya Chutkan of Washington, D.C., decided to postpone hearings in his federal election interference case until September to give the government more time to examine the impact of the decision.
