The House Oversight Committee has rescinded its subpoena for former FBI Director and special counsel Robert Mueller, citing health concerns that render him unable to testify.

“We’ve learned that Mr. Mueller has health issues that preclude him from being able to testify. The Committee intends to withdraw its subpoena,” a committee spokesperson told The Daily Caller.

Mueller’s condition has been the subject of speculation since Real Clear Investigations reported on August 6 that he has been residing in a memory care facility for several years. The move comes only days after Chairman James Comer announced subpoenas for several high-profile figures as part of the panel’s inquiry into the FBI’s handling of the Jeffrey Epstein investigation.

The committee is pressing forward with its probe. Former Attorney General William Barr is scheduled to testify Monday as the first witness. Others facing subpoenas include former FBI Director James Comey and former Attorneys General Loretta Lynch, Eric Holder, Jeff Sessions, Alberto Gonzales, and Merrick Garland. The committee has requested testimony and records concerning their knowledge of the bureau’s actions in the Epstein case.

By withdrawing Mueller’s subpoena, the committee sidesteps a likely clash over his capacity to appear, while keeping its broader focus on allegations of federal mismanagement in one of the nation’s most scrutinized scandals. Further developments in the investigation are expected in the weeks ahead.
