On Thursday, a liberal judge in North Dakota invalidated the state’s extensive pro-life protections, asserting that they were unconstitutional and infringed upon a woman’s “fundamental rights.”

The state constitution’s guarantees for individuals to make their own medical decisions were violated by the law prohibiting abortions after six weeks of pregnancy, according to South Central Judicial District Judge Bruce Romanick.

Drew Wrigley, the Republican Attorney General, expressed his disagreement with the decision, stating that the state would appeal.

Doug Burgum, the Republican Governor of North Dakota, enacted the abortion law in April 2023, asserting that it “reaffirms North Dakota as a pro-life state.”

The law primarily prohibited abortions, but it permitted them in cases of rape or incest before six weeks into a pregnancy. It was enacted in response to a state Supreme Court ruling that invalidated the pulse law, asserting that the state constitution necessitated exceptions.

Following the repeal of Roe v. Wade, liberals have consistently endeavored to challenge state laws that regulate abortion by promoting pro-abortion ballot initiatives and challenging them in the courts.
