Former Trump advisor Steve Bannon has now reportedly filed an emergency appeal with the Supreme Court on Friday, hoping to avoid prison while appealing his conviction for avoiding the House committee that probed the Jan. 6, 2021, Capitol incident.

Bannon was found guilty of two counts of contempt of Congress in 2022 after failing to testify before a House committee on January 6 and refusing to turn over documents.

“There is also no denying the fact that the government seeks to imprison Mr. Bannon for the four-month period immediately preceding the November presidential election. There is no reason for that outcome in a case that presents substantial legal issues.” a statement from Bannon’s attorney read.

A federal judge sentenced him to four months in jail, with an order to report by July 1.

In a 2-1 decision late Thursday, a federal appeals court dismissed Bannon’s request to be released from jail.

In a dissenting opinion, Judge Justin Walker, a former President Trump appointment, said that Bannon should not be imprisoned until the Supreme Court hears his appeal.

The Justice Department’s response to Bannon’s request is due on Wednesday.

Bannon is the second Trump strategist to be sentenced to jail for attempting to dodge a House committee on January 6.

Peter Navarro, Trump’s former economic adviser, is serving a four-month sentence for contempt of Congress after his emergency appeals all failed.
